WIN A HARLEY-DAVIDSON MOTORBIKE DURING SUPER RALLY® 2025 IN BYDGOSZCZ

Due to current laws in Poland, this year during Super Rally® 2025 we are doing a ‘PHOTO FOR HARLEY’ competition instead of a raffle. All you need to do is to follow a few simple steps:

1. take a photo during Super Rally® 2025
2. by 7 June 2025 at 5:30 p.m., post the photo on Facebook on the FH-DCE Super Rally profile under the post about the competition and caption it with two hashtags (#):
#SuperRally2025,
– #individual number from your entry wristband,
3. each participant can only post one photo,
4. the winner of the competition will be the person whose photo receives the highest number of likes,
5. the indication of the competition winner will take place on 7 June 2025 at 19:30 on the main stage of Super Rally® 2025,
6. the winner must be present and must appear on stage after his/her number has been read from the entry wristband,

OFFICIAL “PHOTO FOR HARLEY” COMPETITION RULES

(“Rules“)

1.This competition called PHOTO FOR HARLEY, hereinafter referred to as the “Competition”, is organised by HDC RIDERS OF POLAND, an association with its registered office in Warsaw, address: ul. Ząbkowska 31, 03-736 Warsaw, KRS number 0000519812, REGON 361230460, NIP 5213695218, hereinafter referred to as the “Organiser”.
2.The founder of the prize in the Competition is: Harley-Davidson Europe Limited, a company incorporated under British law with its registered office in Abingdon, address: 192b Park Drive, Milton Park, Abingdon, England, OX14 4SD, Companies House number 02358344 (hereinafter referred to as the “Founder”).
3.The Competition runs from 4 to 7 June 2025 during and subject to the FH-DCE SUPER RALLY® 2025 – an event organised by the Organiser on the premises of the Myślęcinek Forest Park and Culture Centre in Bydgoszcz (“Event”) in accordance with the Event regulations published at: https://superrally2025.com/pl/regulamin-imprezy/.
4.Subject to sections 5 and 6 below, the Competition is open to any participant (“Participant”) who is an adult natural person with full legal capacity participating in the Event and holding valid ticket (a wristband placed on the wrist) entitling them to enter the Event (“Ticket”).
5.The following persons are not eligible to participate in the Competition: a) employees and associates of the Organiser; b) other persons who participated in organising the Competition; c) family members and persons closest to the persons mentioned in letter a) and b) above.
6.The Competition is open to persons who have an access to F H-D C E Super Rally Facebook profile (“Profile”) during the Competition and ability to comment on the Organiser’s post on the Profile.
7.The Competition Rules will be available throughout the Competition on the Profile and on the website at www.superrally2025.com.


Rules and course of the Competition

1.A contest post containing information about the Competition (“Contest Post”) will be posted on the Profile.
2.To participate in the Competition, the Participant should post a comment under the Contest Post, which includes: a) a photo meeting the criteria indicated in section 3 below and b) hashtag # SuperRally2025 and c) the #Participant’s Ticket number printed on the wristband (“Entry”).
3.The Photo included in the Entry should meet the following criteria: a) it was taken personally by the Participant; b) it was taken at the time and place of the Event; c) it does not contain content that is contrary to the law, good customs, ethical and moral standards or the rules of the Event or violates copyrights or personal rights of third parties, inciting racial, religious or ethnic hatred, or promoting violence.
4.A Participant may submit only one Entry. After submitting an Entry, the Participant may not make any changes to the Entry.
5.Entries submitted by 5:30 p.m. on June 7, 2025 will be considered in the Competition.
6.Entries that do not meet the requirements specified in the Rules will not be considered in the Competition.
7.Following the collection of Entries, i.e. after 5:30 p.m. on June 7, 2025, the Contest Committee will verify the Entries.
8.The Participant who meets both of the following conditions shall be announced the winner of the Competition: a) the Contest Committee at the time of verifying the entries in accordance with section 7 above has found the highest number of likes under their Entry, and b) the Participant has not been found by the Organiser violating the Rules or the Event rules.


The Prize

1.The winner of the Competition shall be awarded the following prize: a document entitling the winner to collect a Harley Davidson motorcycle (Softail Standard Model Year 2024 Motorcycle) as indicated in section 7 below (“Prize”).
2.One Prize will be awarded in the Competition.
3.The Organiser will announce the winner of the Competition on June 7, 2025 at 7:30 p.m. on the main stage of the Event, indicating the Entry and the winner’s data provided in the Entry.
4.In order to receive the Prize, the winner whose details were announced in accordance with the section above is obliged to:
a)Report to the members of the Organiser’s Contest Committee present on the main stage of the Event no later than one minute after their details have been announced three times in accordance with section 3 above and
b)present the Ticket, the number of which they provided in the Entry and
c)provide the following details of the recipient of the prize: first name, last name, telephone number, email address, as well as the preferred place of collection of the Prize
(“Winner”).
5.If the winner whose details were announced three times in accordance with section 3 above does not meet the condition indicated in section 4a) above, they lose the right to receive the Prize, and the next Participant who meets the criteria indicated in section 8 of the “Rules and course of the Competition” above shall be announced the winner of the Competition.
6.The procedure of announcing the winner in accordance with the sections above will be carried out as many times as necessary to select the Winner.
7.The Prize shall be collected by the Winner at the Harley-Davidson dealership indicated by the Founder, taking into account the preferences given by the Winner in accordance with section 4c) above, on the date indicated to the Winner by the Founder, but no later than within 60 days of the end of the Competition.
8.The Prize cannot be exchanged, in particular for a cash equivalent or another prize in kind.
9.The Winner will also receive a cash prize of 11.11% of the Prize corresponding to the amount of income tax on the value of the Prize. The cash prize shall not be paid to the Winner. The Winner agrees that the amount referred to in the preceding sentence may be remitted to the relevant tax authority as income tax due.
10.The Organiser is not responsible for delays in issuing the Prize resulting from delays in providing the required information or providing false, incorrect or incomplete information.


Contest Committee

The Contest Committee consists of: the Secretary and Treasurer of the Federation of Harley-Davidson Clubs of Europe and a representative of the Founder.


Personal data

1.The personal data of the Participants shall be controlled by the Organiser to the extent necessary to organise, conduct and decide on the Competition and to remit the Prize tax. Detailed information on the processing of personal data by the Organiser is available in the Organiser’s Information Clause, which constitutes Annex No. 1 to the Rules.
2.The personal data of the Winners shall be controlled by the Founder to the extent necessary to issue and settle the Prize. Detailed information on the processing of personal data by the Founder is available in the Founder’s Information Clause, which constitutes Annex No. 2 to the Rules.


Copyright

1.Should the Entry have the characteristics of a work within the meaning of the Act of 4 February 1994 on copyright and related rights, the Participant, upon posting the Entry, grants the Organiser a free license, with the right to grant further licenses, to use the Entry or its elements, without restrictions as to time and territory, in the following fields of exploitation: recording and reproduction using any techniques; public exhibition, display, making publicly available in such a way that everyone can have access to it at a place and time of their choosing.
2.By posting an Entry, the Participant confirms that they have full rights to the Entry, in particular to publish the content contained in the Entry and declares that they allow the Organiser to record and reproduce the Entry and to publicly exhibit, display, and make the Entry publicly available in such a way that everyone can have access to it at a place and time of their choosing, including on the Organiser’s website and the Organiser’s Facebook profile, for the purposes of the Competition or promotion of the Organiser or the Founder, also in the event that the Entry contains the Participant’s image. If the Entry also contains images of third parties, the Participant shall ensure that he/she has obtained the consent of such third parties to disseminate their images within the scope of these Rules.
3.The Participant confirms that they will bear full responsibility in case anyone depicted in the Entry or having rights to the Entry raises any claims against the Organiser due to the use of the Entry for the purposes specified in these Rules.


Final provisions

1.Any complaints regarding the Competition should be submitted to the Organiser in writing to the following address: HDC RIDERS OF POLAND, an association with its registered office in Warsaw, address: ul. Ząbkowska 31, 03-736 Warsaw together with a description of the complaint, within no more than 14 days from the date on which the basis for the complaint arose, and in any case no later than within 14 days from the date of the end of the Competition. Complaints submitted after the deadline specified above will not be considered, and the Participant has the right to pursue claims in court. Complaints are dealt with by the Contest Committee
2.The Organiser has the right to exclude a Participant from participation in the Competition at any time during the Competition, in particular to refuse to award the Prize to them, if the Organizer has a reasonable suspicion of the Participant’s activity being in conflict with the Rules or the Event rules.
3.By submitting the Entry, the Participants of the Competition: (i) confirm that they acknowledge that the Competition is in no way sponsored, supported or conducted by Facebook or associated with it, and (ii) declare that they fully release Facebook from liability.


Annex No. 1 to the Rules – Organiser’s information clause

1.The Organiser is the Controller of the personal data of the Participants, including the Winners. The Controller can be contacted via e-mail address secretary@ridersofpoland.pl or in writing at ul. Ząbkowska 31, 03-376 Warszawa.
2.The Organiser has appointed a data protection officer, who can be contacted via e-mail address secretary@ridersofpoland.pl or in writing at the Organiser’s registered office address indicated above (in such a case, please add “IOD”), in all matters concerning the processing of personal data and the exercise of rights related to data processing.
3.The personal data of the Participants will be processed for the purpose of:
a)organising, conducting and deciding the Competition – the legal basis for data processing is the necessity of processing for the performance of the contract (Article 6, paragraph 1, letter b of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC [hereinafter: GDPR]);
b)in the case of the Winners – in order to issue the Prize and remit the Prize tax – the legal basis for data processing is the necessity of processing for the performance of the contract (Article 6, paragraph 1, letter b of the GDPR);
c)handling complaints related to the Competition – the legal basis for data processing is the necessity of processing for the performance of the contract (Article 6, paragraph 1, letter b of the GDPR);
d)determining or pursuing any claims or defending against such claims by the Organiser – the legal basis for data processing is the legitimate interest of the Organiser (Article 6, paragraph 1, letter f of the GDPR), consisting in defending its economic interests.
4.Regardless of the above, due to the conduct of the Competition via Facebook, the personal data of Participants and Winners may also be processed by the owner of this service subject to its privacy policy and regulations.
5.The personal data of the Participants may be transferred to entities providing the Organiser with services related to conducting the Competition, including IT service providers and entities providing accounting and advisory services. The recipients of the personal data of Participants, processed in for the purposes indicated in paragraph 3 above, may also be law firms and authorised state bodies and institutions.
The Controller also reserves the right to disclose selected information regarding Participants to competent authorities or third parties who submit a request for such information, based on an appropriate legal basis (in accordance with applicable law).
The Controller will provide the personal data of the Winners, necessary for the purpose of receiving the Prize (name and surname, phone and email address), to the Founder (i.e. Harley-Davidson Europe Limited, a British company with its registered office in Abingdon). The transfer of the Winner’s personal data to the Founder takes place for the purpose of issuing and settling the Prize (legal basis for processing: art. 6 sec. 1 letter b of the GDPR). The Organiser and the Founder are independent controllers of the Winner’s personal data.
6.The personal data of the Participants will be stored for the period necessary to conduct and decide on the Competition, and to the extent necessary to pursue any claims arising from the Competition or defend against claims, the data will be processed until the limitation period expires. After this period, the data will be processed only for the purpose and to the extent resulting from the provisions of law.
7.The Participant has the right to access their data and receive a copy of it, as well as the right to request its rectification, erasure, restriction of its processing, its transfer and the right to object to its processing in connection with their particular.
8.The Participant also has the right to lodge a complaint with the supervisory authority in charge of the personal data protection, i.e. the President of the Personal Data Protection Office based in Warsaw.
9.The Participant may exercise the above rights by submitting a request for their implementation to the Controller in writing to the address of the Organiser’s registered office or electronically to the address indicated in section 2 above.
10.The Controller will transfer the personal data of the Winners to a country outside the European Economic Area – i.e. to the UK – in connection with the provision of personal data to the Founder (i.e. Harley-Davidson Europe Limited, a British company based in Abingdon) in order to enable the issuance and settlement of the Prize. The transfer of personal data to the Founder is based on a decision on adequacy.
11.Providing personal data is voluntary but necessary to participate in the Competition and receive the Prize and to handle complaints. Failure to provide personal data will result in the inability to participate in the Competition, receive the Prize or process the complaint.


Annex No. 2 to the Rules – Founder’s information clause

1.The Founder is the Controller of the personal data of the Winners. The Controller can be contacted via e-mail address DataPrivacy@Harley-Davidson.com. or in writing at 192b Park Drive, Milton Park, Abingdon, England, OX14 4SD.
2.The personal data of the Winners will be processed for the purpose of:
a)issuing and settling the Prize – the legal basis for data processing is the legitimate interest of the Controller (Article 6, paragraph 1, letter f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC [hereinafter: GDPR]), consisting in the necessity to issue and settle the Prize;
b)fulfilling the statutory obligations incumbent on the Controller – resulting in particular from tax and accounting regulations – the legal basis for processing is the legal obligation (Article 6, paragraph 1, letter c of the GDPR);
c)handling complaints related to the issued Prize – the legal basis for data processing is the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR), consisting in handling complaints related to the issued Prize;
d)determining or pursuing any claims or defending against such claims by the Controller – the legal basis for data processing is the legitimate interest of the Controller (Article 6, paragraph 1, letter f of the GDPR), consisting in defending its economic interests.
3.The personal data of the Winners may be transferred to entities providing the Controller with services related to the issuance and settlement of the Prize, including the Controller’s dealerships, IT service providers and entities providing accounting and advisory services. The recipients of the Winners’ personal data, processed in connection with the implementation of the processing purposes indicated in paragraph 3 above, may also be law firms and authorised state bodies and institutions.
The Controller also reserves the right to disclose selected information regarding the Winners to the competent authorities or third parties who submit a request for such information, based on an appropriate legal basis (in accordance with applicable law).
4.The personal data of the Winners will be stored for the period necessary to issue and settle the Prize, and to the extent necessary to pursue any claims related to the Prize or defend against claims, the data will be processed until the statute of limitations expires. After this period, the data will be processed only for the purpose and to the extent resulting from the provisions of law.
5.The Winner has the right to access their data and receive a copy of it, as well as the right to request its rectification, erasure, restriction of its processing, its transfer and the right to object to its processing in connection with their particular.
6.The Winner also has the right to lodge a complaint with the supervisory authority in charge of the personal data protection, i.e. the President of the Personal Data Protection Office based in Warsaw.
7.The Winner may exercise the above rights by submitting a request for their implementation to the Controller in writing to the address of the Founder’s registered office or electronically to the address indicated in section 1 above.
8.The Controller will process the personal data of the Winners in the territory of a country outside the European Economic Area (i.e. the UK) and may transfer the personal data of the Winners to other countries outside the EEA, depending on the location of the dealership responsible for physically handing over the Prize. This processing is based on the adequacy decision.
9.Providing personal data is voluntary but necessary to receive the Prize and to handle complaints. Failure to provide personal data will result in the inability to receive the Prize or process the complaint.
